We are looking to use the TS7221AILT comparator. It is rated for 10V, the absolute maximum is 12V. Our circuit uses 12V and we can't change the design at this time. What is the risk of using this device at the absolute maximum rating?

We are selecting this device as a substitute for our usual component. The output will only need to 'sink' 5.5 mA current. The 12V supply rail is well-regulated.

Expect that you'll need to run your own tests, and develop your own statistics and failure analysis.
